TERMS OF SERVICE

1. Agreement. This website and online store are operated by Hustle Organics ("Hustle Organics", "we", "us", "our"). By visiting the site, creating an order, or using any part of our services you agree to these Terms of Service and to our Shipping Policy, Refund Policy and Privacy Policy, all of which are part of this agreement. If you do not agree, do not use the site or place an order. You must be at least 18 years old, or the age of majority where you live, to place an order.

2. Pre-order sales. Products in the 10,000 POINTS collection are made to order and sold on a limited pre-order basis. Full payment is taken at checkout. The pre-order window closes Monday, October 19, 2026 at 11:59 PM Pacific Time, or earlier if inventory sells out. Quantities are limited by size and color and we may cap or refuse any order. Production begins after the pre-order closes. Any dates we give for production, shipping or delivery, including an estimated December shipping window, are estimates only and not guarantees. Production, supplier, customs and carrier delays can happen and we are not liable for delays outside our reasonable control. Placing a pre-order means you accept these timelines.

3. All sales final. Because every item is made to order, all sales are final. We do not accept returns, exchanges, cancellations or refunds after an order is placed, except where a refund or replacement is required by law or where we ship an item that is defective or materially different from the order, in which case you must contact us within 7 days of delivery with your order number and clear photos. We decide in our sole discretion whether a claim qualifies and the remedy is limited to repair, replacement or refund of the item price. It is your responsibility to choose the correct size. Review the size chart before ordering.

4. Product images and variations. Images shown on this site are design renders and concept visuals, not photographs of finished product. Final garments may differ in color, texture, placement, scale and detail from the renders. Embroidery, patches, rhinestones, prints and washes are handmade or made to order and slight variations between units are normal and are not defects. You accept these variations by ordering.

5. Pricing and payment. All prices are in US dollars and may change at any time before an order is placed. Taxes and shipping are calculated at checkout. We may cancel and refund any order that we suspect is fraudulent, unauthorized, placed in error, or affected by a pricing or listing mistake. By placing an order you confirm that the payment method is yours to use and that your billing information is accurate. Payments are processed by third party providers and we do not store your full card details.

4a. Chargebacks. If you file a chargeback or payment dispute without first contacting us to resolve the issue, or in violation of the all sales final terms you agreed to at checkout, we may dispute it with evidence of your acceptance of these terms, deliver proof of the order, and block you from future purchases. You are responsible for any fees, costs and losses we incur from an improper dispute to the fullest extent allowed by law.

6. Discount codes. Discount codes have no cash value, cannot be combined unless stated, are limited to the terms shown when issued, and may be revoked or voided at any time if we believe they were shared, leaked, resold or misused. Codes cannot be applied after an order is placed.

7. Shipping and risk. We ship to addresses in the United States only. You are responsible for entering a correct and complete shipping address. We are not responsible for orders lost, delayed, returned or misdelivered because of an address error, and reshipping costs are your responsibility. Risk of loss passes to you when the carrier takes possession of the package. Customs, duties or carrier fees, if any, are the recipient's responsibility.

8. Intellectual property. All content on this site, including the Hustle Organics name, logos, 10,000 POINTS, designs, artwork, graphics, photography, renders, text, video and product designs, is owned by or licensed to Hustle Organics and is protected by trademark, copyright and other laws. You may not copy, reproduce, scrape, modify, distribute, sell, or create derivative works, counterfeit goods or replicas from any of it without our prior written permission. Orders are for personal use and not for resale unless we agree in writing.

9. Acceptable use. You agree not to use the site for any unlawful purpose, to interfere with its operation, to attempt unauthorized access, to use bots or automated tools to place orders or bypass quantity limits, to transmit malware, or to submit false information. We may refuse service, cancel orders and ban users at any time and without notice.

10. Disclaimer of warranties. The site and all products are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted, secure or error free, or that product descriptions or other content are complete or accurate.

11. Limitation of liability. To the fullest extent permitted by law, Hustle Organics and its owners, members, employees, contractors, suppliers and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data or loss of goodwill, arising out of or related to the site, your orders or these terms, even if we were told such damages were possible. Our total liability for any claim relating to an order or the site will not exceed the amount you paid for the specific order giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification. You agree to defend, indemnify and hold harmless Hustle Organics and its owners, members, employees, contractors, suppliers and affiliates from any claim, loss, liability, damage or expense, including reasonable attorneys' fees, arising from your breach of these terms, your misuse of the site, or your violation of any law or third party right.

13. Governing law and disputes. These terms are governed by the laws of the State of Minnesota, without regard to conflict of law rules. Any dispute that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its consumer rules, and not in court, except that either party may bring an individual claim in small claims court. You and Hustle Organics each waive the right to a jury trial and the right to bring or take part in any class action, collective or representative proceeding. Before starting any claim you agree to send us written notice of the dispute at the contact address below and to give us 30 days to resolve it. Any claim must be brought within one year after it arose or it is permanently barred. If arbitration is found unenforceable, the exclusive venue for disputes will be the state or federal courts located in Minnesota and you consent to their jurisdiction.

14. Third party services. The site may link to or rely on third party services such as Shopify, payment processors, carriers and social media platforms. We do not control them and are not responsible for their content, availability or practices.

15. Changes. We may update these terms at any time by posting a new version on this page. Your continued use of the site or any order placed after a change means you accept the updated terms. The terms in effect when you placed an order apply to that order.

16. Severability and entire agreement. If any part of these terms is held unenforceable, the rest remains in effect and the unenforceable part will be enforced to the maximum extent allowed. Our failure to enforce any right is not a waiver of it. These terms, together with our policies, are the entire agreement between you and Hustle Organics regarding the site and supersede any prior understanding. You may not assign these terms. We may assign them freely.
